ABSTRACT:

This research aims to analyze the actions and determining factors in the performance of the Municipal Council of Education in Mineiros/GO in guaranteeing the right to quality education socially referenced within the municipality, verifying if its performance characterizes it as an autonomous instrument of civil society representation in the democratization processes of educational public policies. Starting from a critical study about the development of the State and its relations with society, the research was developed in order to analyze the position of the Education Councils in the legal order of the Democratic State of Law, and the possibilities of their action in favor of the State right to education, emphasizing the right-quality-education relationship and limiting the scope of analysis to the Council of the Mineiros/GO municipality. To this end, a literature review was performed sufficient to understand the proposed object, as well as an exploratory documentary research, with the help of data collection techniques, for the collection of documents about the selected CME. The exploratory research revealed the existence of a diversity of documents produced between the period from July 2, 1997 (date of creation of the CME) until April 2016 (when the data collection was closed). After completing the survey and data quantification, systematization techniques were used to facilitate content analysis, prioritizing documents related to legislation, internal regulations, minutes, opinions and resolutions. After the synthesis of the data, qualitative analysis procedures were performed for the construction of the text, based on the schematic structure and the critical argumentation of the content in conjunction with the theoretical framework. It was noticed, after following the methodological path, that although the Education Councils are understood as participative democratic spaces, responsible for exercising deliberative and control functions and social mobilization in the educational field, the Mineiros/GO CME presents almost exclusive performance in matters related to the bureaucratic supervision of educational units, not being observed the exercise of autonomy by this Council, since the majority of the decisions made by the counselors go through some kind of control by the municipal Executive Power. Thus, it was found that the CME has freedom in the accomplishment of its attributions only to the point of not interfering in the executive management of education of the municipality. This situation demonstrates the fragility of the Collegiate's performance in guaranteeing the right to education from a socially referenced perspective, since there is no evidence towards an approximation between the Council and society in order to seek improvements in the municipal education system.
